As a governmental entity, the St. Charles City-County Library District is immune from the permitting and zoning ordinances of local governments that do not relate directly to public health or safety, as long as the project is on land owned by the Library District or the St. Charles Library Building Corporation and is used for library purposes. The Library District shall make a good faith effort to comply with local zoning ordinances, but the Library District need not comply with zoning ordinances if the Library District determines that compliance would be unreasonable or unduly burdensome. The Library District will file applications for approval of its construction projects with the applicable local government, and when doing so shall include a statement substantially similar to the following: This policy shall not apply to facilities leased or rented from non-governmental entities. This policy shall not apply health and/or safety regulations imposed by other units of government. (Approved 10/9/06) |
